1. Parties and Subject
This User Agreement ("Agreement") has been concluded electronically between Home Yatırım Emlak Tur. Tic. İnş. San. Kuy. İhr. Ltd. Şti. ("home.com.tr") and the real or legal person user ("User") who uses the website with the domain name www.home.com.tr, its mobile applications, and affiliated digital platforms. By accessing the platform, creating an account, or continuing to use the platform, the User declares that they have read, understood, and accepted all provisions of this agreement. The subject of this agreement is to determine the terms of use for the digital listing publication, listing, communication, user verification, subscription, and related technological services provided by home.com.tr.
2. Nature of the Platform and Scope of Services
home.com.tr is a technology platform that only provides digital listing and communication infrastructure. The platform is not a party to sales, rentals, commissions, consultancy, payments, transfer of real property, or similar legal and commercial transactions carried out between users. home.com.tr does not act in any way as a real estate consultant, broker, property owner, appraisal organization, financial institution, or investment advisor.
Listings published on the platform are created by the listing owners; the accuracy, currency, legal compliance, and truthfulness of listing contents are entirely the responsibility of the relevant users. home.com.tr does not guarantee the accuracy of any information, visuals, prices, descriptions, title deed information, location, or other content included in listings. Any disputes that may arise between users, damages, fraud attempts, commission disputes, rental or sales relationships, and all liabilities that may arise from title deed transactions belong exclusively to the relevant parties. home.com.tr is not a party to these transactions at any stage and does not provide any guarantee.
home.com.tr operates as an electronic environment provider and intermediary service provider within the scope of the relevant legislation. Listings, content, and user activities created by users on the platform are the responsibility of the relevant users. home.com.tr is not obliged to pre-check user-generated content. home.com.tr does not guarantee that listings published on the platform will result in any sale, rental, reservation, customer conversion, investment return, or commercial success. The platform is not a party to the processes of determining, collecting, or distributing commissions, consultancy fees, service fees, deposits, reservation fees, or similar commercial payments between users.
3. Account Creation and User Obligations
To benefit from platform services, the user may be required to create an account. In cases deemed necessary, home.com.tr may request phone verification, email verification, identity verification, e-Devlet verification, EİDS integration, authorization certificate checks, or additional verification processes. The User accepts that all information and documents provided to the platform are accurate, up to date, complete, and legally compliant. All legal and criminal liability that may arise in the event of providing false information, submitting forged documents, or using third-party information without permission belongs to the user. The User agrees not to publish fake listings, not to create misleading descriptions, not to use fake or stock images, not to engage in spam activities, not to endanger platform security, not to use bot or scraping (data mining) systems, and not to collect platform data without authorization.
Platform services may only be used by natural persons who have reached the age of 18 and by legally authorized legal entities. It is prohibited for persons under the age of 18 to create an account on the platform or benefit from the services. User accounts are personal. Transferring, renting, selling, sharing, or allowing unauthorized use of accounts is prohibited.
4. Listing Publication Rules
The listing owner is responsible for the content of all listings published on the platform. The user may publish listings only for properties they own, have the right to use, or are authorized for. Publishing unauthorized portfolios, using content belonging to third parties, making fake pricing, or creating manipulative listings is prohibited. In cases deemed necessary, home.com.tr may remove any listing from publication without prior notice, notify for editing, suspend it, or delete it entirely. The platform may also request additional documents to verify the accuracy of listings.
5. EİDS and Authorization Verification Processes
home.com.tr may use EİDS and similar verification systems within the scope of compliance with real estate trade legislation. The platform is only a technical integration provider and does not provide any guarantee regarding the legal accuracy of the data obtained from verification systems. Individual consultants holding a Level 5 certificate, real estate offices, and their consultants operating on the platform act as independent service providers. No employee-employer relationship, representation relationship, partnership relationship, or agency relationship is established between these persons and home.com.tr. All obligations arising from users' tax, SGK, BAĞKUR, customer relations, commission processes, and commercial activities belong to the relevant user.
6. Artificial Intelligence Systems and AI Use
AI-supported systems may be used within the platform to improve the user experience. These systems may operate in areas such as creating listing descriptions, search optimization, automatic category suggestions, content filtering, fraud (fraud, forgery, etc.) analysis, moderation, and recommendation systems. The user accepts that content generated by AI systems may produce incorrect, incomplete, misleading, or outdated results. Final review and verification of all AI-generated content is the user's responsibility. home.com.tr does not provide any guarantee regarding the accuracy, completeness, or legal compliance of AI outputs.
7. Messaging and Communication Services
Messaging and communication systems provided on the platform are offered solely for users to communicate. The user agrees not to share insults, threats, fraud, spam, or unlawful content in messages. home.com.tr may store and review messaging records and transaction logs for the purposes of security, moderation, fraud prevention, reviewing user complaints, and responding to requests from official authorities.
8. Subscriptions, Pricing and Payment System
The platform may offer paid subscription systems, packages, showcase services, or digital visibility services. home.com.tr reserves the right to change prices, package contents, listing rights, usage limits, and visibility systems at any time. The user accepts that digital services may begin to be performed immediately after payment. Within the scope of exceptions specified in the legislation, there is no right of refund or withdrawal for used digital services. In the event of payment failure, chargeback, or detection of a suspicious transaction, home.com.tr may suspend the relevant account, deactivate listings, or stop services during the review period.
9. Intellectual Property Rights
All intellectual property rights over the platform's software, design, brand, logo, database, algorithm, interface, visual structure, and technical infrastructure belong exclusively to home.com.tr. The user agrees not to reproduce platform data without authorization, not to use scraping (data mining) or bot systems, not to collect platform content for commercial purposes, and not to misuse API systems.
10. Moderation and Account Closure Authority
home.com.tr reserves the right to suspend, restrict, or completely close the relevant user account in the event that fake listings, spam activities, suspicion of fraud, KVKK violations, unlawful use, platform security risk, use of multiple fake accounts, or actions contrary to this agreement are detected. In serious violations, accounts may be permanently closed without prior notice.
11. Processing of Personal Data
The user accepts the processing of identity information, contact information, IP records, device information, transaction logs, message records, and other declared necessary data for the purpose of providing platform services. home.com.tr aims to process personal data in accordance with the applicable legislation, protect it, and take necessary security measures. However, due to the nature of internet infrastructure, no system can be guaranteed to be completely secure. The platform may share necessary data with relevant institutions in line with legal obligations or requests from official authorities.
12. Limitation of Liability
home.com.tr provides platform services "as is" and "as available". The platform does not provide any express or implied warranty that it will operate uninterrupted, error-free, continuously accessible, or fit for a particular purpose. To the fullest extent permitted by law, home.com.tr cannot be held liable for direct, indirect, special, punitive, or commercial damages that may arise from system outages, maintenance works, internet infrastructure problems, data losses, delays, cyberattacks, problems caused by third-party service providers, software errors, user actions, or technical malfunctions. The user accepts that transactions carried out on the platform are entirely at their own risk and responsibility.
13. Force Majeure
Natural disasters, war, terrorist incidents, fire, power outages, internet infrastructure problems, cyberattacks, decisions of official authorities, and other events beyond the control of home.com.tr will be considered force majeure. During the force majeure period, home.com.tr's obligations may be suspended.
14. Evidence Agreement
The user accepts that the platform's log records, IP records, electronic records, transaction histories, and system data constitute valid evidence within the scope of the Code of Civil Procedure.
15. Applicable Law and Jurisdiction
Turkish Law shall apply to the implementation of this agreement. In disputes that may arise between the parties, the Antalya / Alanya Courts and Enforcement Offices are authorized.
16. Entry into Force
By registering on the platform, using the platform, or continuing to benefit from platform services, the user shall be deemed to have accepted all provisions of this agreement electronically.
If platform services are accessed via mobile applications; Apple App Store, Google Play, or other app stores act only as application distribution service providers and are not directly responsible for platform services. home.com.tr reserves the right to unilaterally update, change, or restrict platform rules, community standards, and terms of use in line with platform security, user experience, legal compliance, and technical requirements.
