USER AGREEMENT

1. Parties and Subject

This User Agreement ("Agreement") is executed electronically between Home Yatırım Emlak Tur. Tic. İnş. San. Kuy. İhr. Ltd. Şti. ("home.com.tr") and the natural or legal person user ("User") utilizing the website with the domain name www.home.com.tr, its mobile applications, and affiliated digital platforms. By accessing the platform, creating an account, or continuing to use the platform, the User declares that they have read, understood, and accepted all provisions of this agreement in its entirety. The subject of this agreement is to determine the terms of use for digital listing publishing, listing, communication, user verification, subscription, and related technological services provided by home.com.tr.

2. Nature of the Platform and Scope of Service

home.com.tr is solely a technology platform providing digital listing and communication infrastructure. The platform is not a party to sales, leasing, commission, consultancy, payment, property transfer, or similar legal and commercial transactions carried out between users. home.com.tr does not act as a real estate agent, broker, property owner, appraisal company, financial institution, or investment advisor in any capacity.

Listings published on the platform are created by the listing owners; the accuracy, currency, legal compliance, and truthfulness of the listing contents are entirely the responsibility of the respective users. home.com.tr does not guarantee the accuracy of the information, visuals, prices, descriptions, title deed information, location, or other contents contained in the listings. All liability arising from disputes, damages, fraud attempts, commission conflicts, lease or sales relationships, and title deed transactions that may occur between users belongs exclusively to the respective parties. home.com.tr is not a party or guarantor at any stage of these transactions.

home.com.tr operates as an electronic hosting provider and intermediary service provider within the scope of relevant legislation. The listings, contents, and user activities created by users on the platform are the responsibility of the relevant users. home.com.tr is not obliged to monitor the contents created by users in advance. home.com.tr does not guarantee that the listings published on the platform will provide any sales, rental, reservation, customer conversion, return on investment, or commercial success. The platform is not a party to the processes of determining, collecting, or distributing commissions, consultancy fees, service fees, deposits, reservation fees, or similar commercial payments between users.

3. Account Creation and User Obligations

Users may be required to create an account to benefit from platform services. When deemed necessary, home.com.tr may request phone verification, email verification, identity verification, e-Government (e-Devlet) verification, EIDS integration, authorization certificate control, or additional verification processes. The User accepts that all information and documents provided to the platform are accurate, up-to-date, complete, and legally compliant. All legal and penal responsibilities arising from providing false information, submitting fake documents, or unauthorized use of third-party information belong to the User. The User agrees not to publish fake listings, create misleading descriptions, use fake or stock visuals, engage in spam activities, endanger platform security, use bot or scraping systems, or collect platform data without authorization.

Platform services can only be used by real persons over the age of 18 and legally authorized legal entities. Individuals under the age of 18 are prohibited from creating an account or using services on the platform. User accounts are personal. Transferring, renting, selling, sharing, or unauthorized use of accounts by third parties is prohibited.

4. Listing Publishing Rules

The listing owner is responsible for the content of all listings published on the platform. A User may only publish listings for properties they own, have the right to use, or are authorized for. Publishing unauthorized portfolios, using third-party content, fake pricing, or creating manipulative listings is prohibited. home.com.tr may, when it deems necessary, remove any listing without prior notice, request its modification, suspend it, or delete it entirely. The platform may also request additional documents to verify the accuracy of the listings.

5. EIDS and Authorization Verification Processes

home.com.tr may use EIDS (Electronic Listing Verification System) and similar verification systems in compliance with real estate trade legislation. The platform is solely a technical integration provider and does not guarantee the legal accuracy of the data obtained from verification systems. Individual consultants with a Level 5 certificate, real estate offices, and consultants operating on the platform act as independent service providers. No employer-employee, agency, partnership, or proxy relationship is established between these individuals and home.com.tr. All obligations arising from taxes, social security (SGK, BAĞKUR), customer relations, commission processes, and commercial activities of the users belong to the relevant user.

6. Artificial Intelligence Systems and AI Usage

Artificial intelligence-supported systems may be used within the platform to improve the user experience. These systems may operate in areas such as listing description generation, search optimization, automatic category recommendations, content filtering, fraud analysis, moderation, and recommendation systems. The User acknowledges that content generated by AI systems may produce inaccurate, incomplete, misleading, or outdated results. The ultimate control and verification of all content generated by artificial intelligence is the responsibility of the User. home.com.tr does not provide any guarantees regarding the accuracy, completeness, or legal compliance of AI outputs.

7. Messaging and Communication Services

The messaging and communication systems provided on the platform are strictly for users to communicate with each other. The User agrees not to share insulting, threatening, fraudulent, spam, or illegal content in messages. home.com.tr may store and review messaging records and transaction logs for security, moderation, fraud prevention, investigating user complaints, and responding to requests from official authorities.

8. Subscriptions, Pricing, and Payment System

The platform may offer paid subscription systems, packages, showcase services, or digital visibility services. home.com.tr reserves the right to change prices, package contents, listing limits, usage limits, and visibility systems at any time. The User accepts that digital services may begin to be executed immediately after payment. Under the exceptions specified in the legislation, there is no right of return or withdrawal regarding the utilized digital services. In case of payment failure, chargeback, or detection of a suspicious transaction, home.com.tr may suspend the relevant account, deactivate listings, or halt services during the review period.

9. Intellectual Property Rights

Intellectual property rights over all software, design, brand, logo, database, algorithm, interface, visual structure, and technical infrastructure belonging to the platform exclusively belong to home.com.tr. The User agrees not to reproduce platform data without authorization, not to use scraping or bot systems, not to collect platform content for commercial purposes, and not to abuse API systems.

10. Moderation and Account Closure Authority

home.com.tr reserves the right to suspend, restrict, or completely close the relevant user account in case of detection of fake listings, spam activities, suspected fraud, KVKK (Data Protection) violations, illegal use, platform security risks, use of multiple fake accounts, or behaviors contrary to this agreement. In cases of severe violations, accounts may be permanently closed without prior notice.

11. Processing of Personal Data

The User accepts the processing of identity information, contact information, IP records, device information, transaction logs, message records, and other declared necessary data in order for the platform services to be provided. home.com.tr aims to process and protect personal data in accordance with the current legislation and take necessary security measures. However, due to the nature of internet infrastructure, no system can be guaranteed to be completely secure. The platform may share necessary data with relevant institutions in line with legal obligations or requests from official authorities.

12. Limitation of Liability

home.com.tr provides platform services "as is" and "as available". The platform makes no express or implied warranties that it will operate uninterrupted, error-free, continuously accessible, or suitable for a particular purpose. home.com.tr cannot be held liable to the fullest extent permitted by law for any direct, indirect, special, punitive, or commercial damages arising from system outages, maintenance work, internet infrastructure problems, data loss, delays, cyber attacks, third-party service provider issues, software bugs, user actions, or technical glitches. The User accepts that transactions carried out on the platform are entirely at their own risk and responsibility.

13. Force Majeure

Natural disasters, war, terrorist incidents, fire, power outages, internet infrastructure problems, cyber attacks, decisions of official authorities, and other events developing beyond the control of home.com.tr shall be considered as force majeure. home.com.tr's obligations may be suspended during the force majeure period.

14. Evidence Agreement

The User accepts that log records, IP records, electronic records, transaction histories, and system data belonging to the platform constitute valid evidence under the Code of Civil Procedure.

15. Applicable Law and Jurisdiction

Turkish Law shall apply to the implementation of this agreement. Antalya / Alanya Courts and Enforcement Offices are authorized to resolve disputes that may arise between the parties.

16. Entry into Force

By registering on the platform, using the platform, or continuing to benefit from the platform services, the User is deemed to have accepted all provisions of this agreement electronically.

If platform services are accessed via mobile applications; Apple App Store, Google Play, or other app stores act merely as application distribution service providers and are not directly responsible for the platform services. home.com.tr reserves the right to unilaterally update, modify, or limit the platform rules, community standards, and terms of use in line with platform security, user experience, legal compliance, and technical requirements.

5. Method and Legal Reason for Collecting Personal Data

6. Retention Periods

The user agrees to be obliged to check the listing descriptions generated by artificial intelligence before publishing them. All responsibility arising from false information, incomplete descriptions, misleading statements, technical errors, incorrect category matching, or illegal content that may occur in descriptions generated by AI systems belongs to the respective user. home.com.tr cannot be held liable for any direct or indirect damages that may arise from AI-supported content.

These systems can automatically detect, review, limit, or remove fake listings, spam content, manipulative behaviors, fraud attempts, suspicious user movements, or content violating community rules. The User accepts that AI moderation systems may contain technical errors and that some actions may be performed by automated systems. home.com.tr reserves the right to manually review, alter, or revoke moderation decisions when deemed necessary.

User data may be analyzed by AI systems to ensure platform security, improve user experience, optimize recommendation systems, conduct moderation processes, and perform technical analyses. In this context, user behaviors, search histories, platform usage habits, device information, listing movements, interaction records, and security logs may be processed by the systems. home.com.tr aims to apply data minimization and anonymization principles to the extent possible.

The User accepts that the AI systems used on the platform involve evolving technologies and that no guarantee is provided that the systems will run uninterruptedly, error-free, or continuously produce accurate results. home.com.tr is not responsible for any direct or indirect damages that may arise from content generated by AI systems, automated moderation actions, recommendation systems, analysis results, or technical classifications. ACCOUNT AND MEMBERSHIP AGREEMENTS

CORPORATE ACCOUNT AGREEMENT

Corporate accounts cover special account types created for real estate agencies, construction companies, and individual real estate consultants with a Level 5 certificate. The corporate user is responsible for all sub-accounts they create on the platform, employee activities, consultant transactions, listing contents, and user actions. The corporate user is also obliged to ensure the legal compliance of published content. When deemed necessary, the platform may audit corporate accounts, request additional documents, limit accounts, or suspend them for security purposes. Showcase services, premium visibility solutions, AI-supported recommendation systems, advertising services, or lead systems offered on the platform do not imply any guarantee of customers, sales, leasing, transaction volume, return on investment, or commercial profit.

INDIVIDUAL USER ACCOUNT AGREEMENT

The Individual User Account is an account type created for real persons who wish to publish real estate listings, search for real estate, review contents related to purchasing or leasing processes, communicate with users, and benefit from platform services for personal purposes. The User accepts that they can only create listings for real estate they own, have the right to use, or are legally authorized to list on the platform. Unauthorized portfolio use, publishing fake listings, listing third-party properties without authorization, creating misleading descriptions, or sharing manipulative content is prohibited. Users searching for real estate on the platform accept that the listing contents are created by the respective users and that home.com.tr does not guarantee the accuracy, currency, legal status, price information, stock status, or actual suitability of the listings. The User accepts that the risks arising from purchase, lease, investment, or commercial transactions to be carried out based on the content on the platform belong to them. The User agrees not to engage in spam activities, use automatic data collection systems, perform actions that will violate platform security, create fake user movements, and not engage in deceptive behaviors towards other users. When deemed necessary, the platform may perform identity verification, document requests, property verification, EIDS control, or additional security checks. The User accepts that the information and documents they provide within the scope of verification processes are accurate and up-to-date. The User agrees that they are exclusively responsible for the security of their account information, will not share account access credentials with third parties, and will not transfer their account. home.com.tr operates solely as a platform providing digital listing, communication, and tech infrastructure. The platform is not a party to sales, leasing, reservations, deposits, commissions, consultancy, or other commercial transactions executed between users. home.com.tr does not guarantee the accuracy of listings published by individual users; legal, administrative, or penal responsibilities arising from listing contents, user behaviors, or transactions between users belong to the relevant user. When necessary, the platform reserves the right to review listings, remove content, suspend accounts, or limit platform access. home.com.tr reserves the right to modify this Individual User Account Agreement at any time. The updated agreement becomes effective on the date it is published on the platform.

INDIVIDUAL REAL ESTATE CONSULTANT ACCOUNT AGREEMENT

The Individual Real Estate Consultant Account is an account type created for real persons who provide professional services within the scope of real estate trade activities, conduct independent consultancy, and publish real estate listings on the platform. The User accepts that they possess the necessary authorization documents, professional qualifications, and legal permissions under the relevant legislation, that they conduct their activities in accordance with the current real estate trade legislation, and that they are fully responsible for all listings they publish on the platform. When deemed necessary, home.com.tr may perform authorization certificate verification, certificate review, EIDS integration, portfolio verification, identity verification, or additional document controls. The User accepts that all information and documents provided during the verification processes are accurate, up-to-date, and legally compliant. The accuracy, currency, legal compliance, price information, property details, visuals, descriptions, and authorization status of the listings published on the platform are the responsibility of the respective consultant. Unauthorized portfolio use, publishing fake listings, creating manipulative content, or sharing misleading information is prohibited. Individual real estate consultants act as independent service providers. No employer-employee relationship, partnership, agency relationship, commercial proxy, or representation relationship is established between the User and home.com.tr. All legal, administrative, and financial responsibilities arising from the User's customer relations, commission processes, tax obligations, SGK/BAĞKUR responsibilities, commercial activities, and professional transactions belong to the respective user. home.com.tr operates solely as a platform providing digital listing, communication, and tech infrastructure. The platform is not a party to sales, leasing, commission, reservations, customer management, or commercial transactions executed by consultants. The platform may offer various professional services to individual real estate consultant accounts. In this context, premium visibility solutions, AI-supported lead systems, recommendation algorithms, advertising systems, advanced listing tools, or additional digital services may be provided. However, these services do not imply any guarantee of customers, income, sales, transaction volume, or commercial success. The User accepts that all activities they carry out on the platform are in compliance with current legislation. home.com.tr reserves the right to review user accounts, expand verification processes, remove listings, suspend accounts, or restrict platform access when deemed necessary. The User accepts that the content they publish on the platform does not violate the rights of third parties and that they hold the necessary usage rights. home.com.tr reserves the right to modify this Individual Real Estate Consultant Account Agreement at any time. The updated agreement takes effect from the date it is published on the platform.

REAL ESTATE AGENCY ACCOUNT AGREEMENT

The Real Estate Agency Account is an account type created for real estate offices, real estate consultancy companies, and professional real estate enterprises conducting real estate trade activities under a corporate structure. The corporate user accepts that they are exclusively responsible for all listings published under the account they create on the platform, as well as for all user activities, sub-user transactions, employee actions, consultant activities, and customer relations. Within the scope of agency accounts created on the platform; consultant accounts, employee profiles, sub-user authorizations, portfolio management systems, corporate showcase areas, advertising solutions, AI-supported systems, API services, or integration infrastructures can be used. The User accepts that all legal, administrative, and commercial liability arising from the use of these systems belongs to them. The real estate agency is responsible for all actions carried out by its employees, consultants, sub-users, portfolio managers, or other persons with account access. User actions, messaging, listing publishing activities, price updates, portfolio entries, and customer transactions executed on the platform are deemed to have been made on behalf of the corporate user. The User accepts that they can only create listings for real estate they are legally authorized to list on the platform. Unauthorized portfolio use, fake listing publishing, manipulative pricing, actively displaying out-of-stock properties, creating misleading descriptions, or unauthorized use of third-party content is strictly prohibited. home.com.tr may request a real estate trade authorization certificate, tax plate, trade registry details, authorized person verifications, EIDS verifications, portfolio verifications, and additional security documents from the corporate user when deemed necessary. Consultants operating on the platform act as independent service providers. No employer-employee relationship, agency relationship, partnership, or commercial proxy relationship is established between home.com.tr and the corporate user, consultants, or employees. home.com.tr operates solely as a digital listing, communication, and technology platform provider. The platform is not a party to sales, leasing, commissions, customer referrals, consultancy, or commercial transactions executed between users. The User accepts that all legal, financial, and administrative responsibilities arising from customer relations, commission processes, employee management, consultant activities, tax obligations, SGK/BAĞKUR processes, contractual relationships, and commercial activities belong to them. When deemed necessary, the platform reserves the right to review corporate accounts, verify listings, limit sub-user access, suspend accounts, or restrict certain transactions for platform security purposes. home.com.tr may use AI-supported moderation systems, fraud analysis infrastructures, IP analysis systems, multiple account controls, and behavioral risk analyses to ensure platform security. Advertising packages, premium visibility solutions, AI-supported lead systems, showcase areas, or API services offered on the platform do not guarantee any customers, income, transaction volume, or commercial success. The User accepts that they hold the usage rights to all content they publish on the platform and that they do not violate the intellectual property rights of third parties. home.com.tr reserves the right to change this Real Estate Agency Account Agreement at any time. The updated agreement comes into force on the date it is published on the platform.

CONSTRUCTION COMPANY ACCOUNT AGREEMENT

The Construction Companies Account is an account type created for real or legal persons who develop projects, conduct mass housing or commercial real estate projects, engage in construction activities, create real estate projects for investment purposes, or manage mass sales processes. The User accepts that all technical, legal, financial, and commercial information regarding the projects, real estate, and sales processes they publish on the platform are accurate, up-to-date, and legally compliant. All legal and commercial responsibility arising from project descriptions, visuals, delivery dates, advertising content, pricing, independent unit details, square meter information, location data, sales conditions, campaigns, payment plans, and promotional materials belongs to the respective user. The User accepts that they are fully responsible for the accuracy of stock information, independent unit status, sales availability data, availability records, and project inventory information regarding the projects published on the platform. Any liability arising from the incorrect active display of properties on the system that have been sold, reserved, closed for sale, or are not physically available belongs to the relevant user. home.com.tr does not guarantee the legal, technical, financial, or commercial accuracy of the projects, properties, or investment contents published on the platform. Contents located on the platform do not constitute investment advice, financial consultancy, legal consultancy, or appraisal services. The User accepts that they are entirely responsible for the license status, zoning processes, delivery dates, building permits, technical specifications, financial structures, and sales processes of the projects published on the platform. home.com.tr operates solely as a technology platform providing digital listing, promotion, and communication infrastructure. To ensure platform security, home.com.tr may apply fake listing detection, multiple account analysis, user behavior analysis, AI-supported fraud detection, and automated security controls. If suspicious activity is detected, the relevant listings may be temporarily suspended, additional documents may be requested from the user, or the account may be suspended.

EIDS integrations, verification infrastructures, and authorization control systems used within the platform are solely used to conduct technical verification processes. home.com.tr is merely a technical integration provider. The accuracy, currency, and legal validity of official data records are the responsibility of the relevant official institutions, data providers, or the listing owner. The User accepts that the verification processes performed on the platform do not create any business relationship, representation relationship, partnership relationship, proxy relationship, or employer-employee relationship in any way. Individual users, individual real estate consultants, real estate agencies, and construction companies operating on the platform act as independent service providers. home.com.tr is not responsible for users' commercial activities, customer relations, commission processes, tax obligations, property sales, or legal transactions.

The User accepts that all information and documents presented during the verification processes are accurate, up-to-date, and legally compliant. In the event of the use of fake documents, providing misleading information, or attempting to manipulate verification systems, home.com.tr reserves the right to suspend the relevant account, remove listings, or completely close the account. home.com.tr has the right to change, expand, restrict, or update the verification processes at any time for platform security and legislative compliance purposes.

LISTING PUBLISHING RULES

Spam contents, repetitive listings, duplicate listings, manipulations aimed at creating artificial visibility, fake user movements, bot usage, or actions designed to mislead platform algorithms are considered contrary to platform rules.

To ensure platform security, home.com.tr may use AI-supported moderation systems, fraud analysis systems, spam detection infrastructures, and automatic control mechanisms. The platform may, when it deems necessary, review any listing without prior notice, limit its visibility, unpublish it, or request additional documents from the user. The User agrees to participate in the verification processes to be carried out by the platform in a cooperative manner. When necessary, home.com.tr may perform EIDS verification, property verification, identity verification, authorization certificate control, or additional security reviews.

In case of behavior contrary to platform rules, various sanctions may be applied by home.com.tr. Depending on the nature of the violation, a warning may be issued to the user, the relevant listing may be temporarily suspended, the listing may be completely removed, the user account may be permanently closed, or IP and device-based access blocks may be applied to protect platform security. home.com.tr reserves the right to take all necessary technical and legal measures against transactions that threaten platform security, mislead users, constitute activities contrary to legislation, or damage platform integrity. The ultimate responsibility for the accuracy of the listings published on the platform belongs to the listing owner, and home.com.tr acts merely as a technology platform providing digital listing and communication infrastructure. The platform is not a party to sales, leasing, commission, or consultancy relationships occurring between users. home.com.tr reserves the right to change these Listing Publishing Rules at any time. DISTANCE SERVICE AND SUBSCRIPTION AGREEMENT

To protect platform security, home.com.tr reserves the right to temporarily or permanently suspend user accounts engaged in suspicious activities. The moderation systems used on the platform may operate completely automatically or with AI support. The User accepts that AI-supported moderation systems may contain technical errors and some actions may be performed by automated systems. When it deems necessary, home.com.tr reserves the right to manually review, change, or revoke moderation decisions. For the purpose of ensuring platform security, user data, security logs, and technical records may be retained in accordance with the applicable legislation and shared with relevant institutions in line with requests from official authorities. home.com.tr solely offers digital platform services and is not a party to sales, leasing, commission, or commercial transactions taking place between users.
